Traffic Infractions

 

You are presumed innocent until proven guilty and you have the right to retain an attorney to represent you now, or at any stage in these proceedings.  The court may not provide you with a recommendation as to how you should proceed, or as to which of these options you should choose. 

 

NOTE:  You are given an appearance date at the time the ticket is issued and you are required to appear in person or submit your plea by mail by that date.  Failure to do so will result in the suspension of your driver’s license by the NYS Department of Motor Vehicles.

 

If you receive a Traffic Ticket and the Offense Type on the front of the ticket is a Misdemeanor, you must appear in Court on the Date written on the ticket to be arraigned before the Justice.  Failure to do so may result in a Warrant for your Arrest.

 

If the Offense Type is a Traffic Infraction, you can plead GUILTY or NOT GUILTY

 

Plead Guilty as Charged

Fill out Part A of the Uniform Traffic Ticket.  Return the ticket to the Court by mail, include your current mailing address and sign it.  Send it by Certified Mail.  The court will notify you by first class mail of the fines and mandatory surcharge assessed.  Please be advised that because this is a part-time court, your plea by mail may take two (2) – three (3) weeks for processing.  Or appear in person before the Justice on the date of your scheduled appearance found on your ticket.

Plead Not Guilty

Fill out Part B of the Uniform Traffic Ticket.  Return the ticket to the Court by mail, include your current mailing address and sign it.  Send it by Certified Mail.  Or appear in person before the Justice on the date of your scheduled appearance found on your ticket. 

 

After your “Not Guilty” plea is entered, your case will be scheduled for a Pre-Trial Conference with the Assistant District Attorney.  The Court will advise you of the conference date and time.  If you are unable to attend the Pre-Trial Conference, there will be instructions included in your “Not Guilty Letter” on how to contact them by mail.  This MUST be done prior to the assigned Pre-Trial Conference date.   If you are given a negotiated plea recommendation from the Assistant District Attorney and you do not accept the recommendation, the matter will be set down for a non-jury trial.  If you accept the negotiated plea recommendation, you must sign it and submit it to the court.
